4. Personal data & GDPR

Purpose of processing: personal data collected (name, first name, email, phone number) is used exclusively to manage appointments, send confirmations and reminders, manage gift cards, and handle invoicing. Date of birth, when shared with the Client's express consent during an appointment, is used only to send an annual personalised birthday email with a promotional offer (15% discount code).

Legal basis: performance of the service contract (Article 6.1.b GDPR) for managing appointments and payments, legal obligation (Article 6.1.c GDPR) for accounting requirements, and consent (Article 6.1.a GDPR) for sending birthday emails and promotional offers. Consent may be withdrawn at any time via the unsubscribe link included in every birthday email.

Data recipients: data may be shared with the following technical subcontractors, strictly within the scope of the service's operation: Stripe Inc. (secure payment processing — PCI-DSS certified), Resend Inc. (transactional email delivery), Neon Inc. (database hosting — Frankfurt region, EU), Vercel Inc. (website hosting and anonymised audience measurement — cookie-free), Sentry (technical error monitoring).

Transfers outside the EU: data processed by Stripe, Resend, Vercel and Sentry may be transferred to servers located in the United States. These transfers are governed by the European Commission's standard contractual clauses (Article 46.2.c GDPR) and, where applicable, the EU-U.S. Data Privacy Framework.

Retention period: client data is retained for 3 years from the last appointment or purchase. Invoicing data is retained for 10 years in accordance with accounting obligations (Article L.123-22 of the French Commercial Code).

Your rights: in accordance with Regulation (EU) 2016/679 (GDPR) and amended French Law No. 78-17 of 6 January 1978, you have the right to access, rectify, erase, restrict the processing of, port, and object to the processing of your data.

To exercise these rights: send your request to contact@vaguedessens.fr with a copy of proof of identity. A response will be provided within 30 days.

You also have the right to lodge a complaint with the CNIL (French Data Protection Authority) — www.cnil.fr

5. Cookies and trackers

The vaguedessens.fr website uses only cookies strictly necessary for the service to function: admin area authentication and user session management.

These cookies are exempt from consent requirements in accordance with CNIL recommendations (deliberation No. 2020-091 of 17 September 2020).

No advertising, profiling, social media or behavioural tracking cookies are placed on your device.

The website uses Vercel Web Analytics and Vercel Speed Insights for audience and performance measurement. These tools place no cookies and collect no identifiable personal data.

6. Card guarantee hold & payment security

When booking a treatment online, a card guarantee hold is registered via Stripe Inc. (PCI-DSS level 1 certified). No card data passes through Vague des Sens' servers.

No charge is made at the time of booking. The card hold is used solely as a guarantee in the event of a late cancellation (less than 12 hours before the appointment) or a no-show.

In the event of a late cancellation or no-show, an amount equal to 50% of the price of the booked treatment may be charged to the registered card.

Gift card payments are made online by card, Apple Pay or Google Pay, via the secure Stripe platform.

7. Liability

Vague des Sens strives to keep the information published on the website up to date and accurate, but does not guarantee the absence of errors or omissions.

Vague des Sens cannot be held liable for the interpretation of the information contained on the website, nor for the consequences of its use.

The website may contain hyperlinks to third-party websites. Vague des Sens disclaims all liability for the content of these external sites.

Vague des Sens cannot be held liable for any direct or indirect damage resulting from access to the website or the inability to access it.

8. Consumer dispute mediation

In accordance with Articles L.611-1 et seq. and R.612-1 et seq. of the French Consumer Code, Vague des Sens offers its consumer clients a consumer mediation scheme.

Terms and Conditions of Sale

Applicable to online treatment bookings and gift card purchases

Article 1 — Purpose

These Terms and Conditions of Sale ("Terms") govern the business relationship between Laura Osorio, trading as Vague des Sens (SIRET: 881 803 837 00031), and any individual booking a treatment or purchasing a gift card on the vaguedessens.fr website (hereinafter "the Client").

Booking a treatment or purchasing a gift card constitutes full and unconditional acceptance of these Terms.

Article 2 — Services offered

Vague des Sens offers wellness massage and body and facial treatments, performed by Laura Osorio.

The key characteristics of each treatment (description, duration, price) are presented on the dedicated page of the website before any booking is made.

Laura Osorio operates as an aesthetic comfort massage practitioner (APE code 96.02B). The services offered are strictly wellness and relaxation-oriented, and do not under any circumstances constitute medical, paramedical or physiotherapy acts.

Article 3 — Pricing

Prices are displayed in euros, all taxes included. VAT applicable at a rate of 20% (VAT No.: FR72881803837).

Payment for treatments is made directly at the salon, at the end of the session, by card, cash or cheque.

For treatment packages (cures), payment facilities are available: instalments or pay-per-session, to be arranged directly with Laura.

Vague des Sens reserves the right to change its prices at any time. Applicable prices are those displayed at the time of booking or purchase.

Article 4 — Online booking

Booking a treatment on vaguedessens.fr is confirmed immediately once a time slot is available, with no manual validation required.

A confirmation email containing the appointment details and a calendar file (.ics) is sent automatically to the email address provided by the Client.

Slots can be booked from 12 hours in advance (including the same day, provided this notice is met) and up to 30 days in advance.

The Client agrees to provide accurate information when booking (first name, last name, email, phone number).

Article 5 — Rescheduling and cancelling appointments

The Client may reschedule or cancel their appointment free of charge up to 12 hours before the scheduled time, via the "Reschedule or cancel" link included in the confirmation email.

Late cancellation: any cancellation made less than 12 hours before the appointment may result in a charge equal to 50% of the treatment's price, taken from the card registered at the time of booking.

No-show: in the event of an unannounced absence, the same 50% charge may apply.

Rescheduling: online rescheduling of an appointment is only possible 12 hours or more before the scheduled time. Within this window, only cancellation is possible, subject to the late-cancellation fee (50% of the treatment's price).

Vague des Sens reserves the right to cancel or reschedule an appointment in the event of force majeure, illness or exceptional circumstances. The Client will be informed as soon as possible and offered a new time slot.

Article 6 — Treatment packages (cures)

Treatment packages ("cures") are bundles comprising a set number of sessions at a preferential rate.

When booking a package online, only the first session is scheduled. Subsequent sessions are arranged directly with Laura at the salon.

Packages are valid for 6 months from the date of booking.

Packages are personal and non-transferable.

If a package is abandoned partway through, no refund will be issued for unused sessions, except at Laura Osorio's discretion.

Article 7 — Gift cards — Purchase

Vague des Sens gift cards can be purchased on vaguedessens.fr for an amount between €20 and €500.

Payment is secure and processed entirely by Stripe (PCI-DSS certified). Card details never pass through Vague des Sens' servers.

Once payment is confirmed, an email containing the gift card's unique code and a printable PDF is sent to the purchaser's address. If a recipient's address has been provided, an email is also sent to the recipient.

Article 8 — Gift cards — Use

Gift cards are valid for 12 months from the date of purchase.

They may be used towards any treatment offered by Vague des Sens, except duo and four-hand massages (performed in partnership with an outside provider). The available balance is deducted from the price of the chosen treatment.

If the treatment's price exceeds the card's balance, the remaining amount must be paid by the recipient at the salon.

Gift cards are neither refundable nor exchangeable for cash, and cannot be combined with one another on a single booking.

If a code is lost, the Client may contact contact@vaguedessens.fr, providing the email address used for purchase.

Article 8 bis — Birthday coupon — Use

A 15% discount coupon is automatically emailed to clients who have provided their date of birth, one week before their birthday.

The coupon is valid from the day of the birthday for 30 days; it cannot be activated before that date.

It may be used towards any individual treatment offered by Vague des Sens, except duo and four-hand massages (performed in partnership with an outside provider), and does not apply to product purchases.

The coupon is personal and non-transferable: it can only be used with the email address of the client to whom it was sent, not with another account.

It cannot be combined with a gift card or another coupon, nor is it refundable or exchangeable for cash.

Article 9 — Right of withdrawal

Gift cards: in accordance with Article L.221-18 of the French Consumer Code, the Client has 14 days from the date of purchase to exercise their right of withdrawal, provided the card has not been used (code not redeemed). The request must be sent to contact@vaguedessens.fr, preferably using the withdrawal form template provided in the appendix to these Terms. A refund will be issued within 14 days via the same payment method.

Treatment bookings: in accordance with Article L.221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure services with a specific date or period of performance. Treatment bookings are therefore not subject to the right of withdrawal.

Article 10 — Liability

Vague des Sens undertakes to provide its services with the utmost care and in accordance with best practices applicable to wellness massage.

The Client must disclose any medical contraindication, allergy, injury or specific health condition (including pregnancy) before the session begins.

Vague des Sens cannot be held liable for damage resulting from incorrect or incomplete information provided by the Client.

In the event of being unable to honour an appointment due to force majeure (within the meaning of Article 1218 of the French Civil Code), Vague des Sens undertakes to notify the Client as soon as possible and offer a new time slot, at no charge to the Client.

Article 11 — Governing law and jurisdiction

These Terms are governed by French law.

In the event of a dispute, the parties agree to seek an amicable solution before pursuing legal action. Failing that, the dispute will be submitted to the competent courts of Clermont-Ferrand.

Article 12 — Legal guarantees

Gift cards: in accordance with Articles L.217-3 et seq. of the French Consumer Code, the Client benefits from the legal guarantee of conformity for digital content and services. In the event of a non-conforming gift card (invalid code, incorrect amount, non-receipt), the Client may contact contact@vaguedessens.fr to obtain a free remedy.

Services: wellness massage services are subject to a best-efforts obligation. Vague des Sens undertakes to perform each treatment with the utmost care and in accordance with best practices.
